Raping niece lands man 8 years jail term in Dowa

A 26-year-old man in Dowa, has been convicted and sentenced to eight years imprisonment with hard labour for raping and impregnating his 16-year-old niece.

The Dowa First Grade Magistrate's Court through state prosecutor Inspector Christopher Daluni heard that the convict  committed the offence on October 20, 2020.

State prosecutor Inspector Daluni further told the jam-parked court that the victim is a niece to the accused and she was under his custody.

It was also further learnt in court that because of poverty, the accused took advantage of the situation and told her that if she wanted any assistance from him, she must accept to have sexual intercourse with him.

The victim could not resist the situation due to poverty and she is now 6 months pregnant after undergoing medical examination at Dowa District Hospital.

Appearing before court, the convict pleaded guilty to a charge of rape contrary to Section 133 of the Penal Code leading to his conviction.

In his submission, state prosecutor Inspector Dulani asked the court to mete out a stiff punishment to the offender, saying the offence committed is serious in nature and that the convict had a responsibility to take care of her sister's daughter and not abusing her.

Presiding over the case, First Grade Magistrate Amran Phiri quashed the convict's mitigation factors for a lenient sentence, and hence sentenced him to 8 years imprisonment with hard labour as a deterrent to others with similar intentions.
